Diduga Rugikan Nasabah Rp32 Miliar, Direktur BPR Lestari Dilaporkan ke Mabes Polri
Denpasar, PancarPOS | Direktur Utama Bank BPR Lestari, Pribadi Budiono dilaporkan ke Mabes Polri atas dugaan tindak pidana kejahatan perbankan. Kasus ini dilaporkan oleh nasabahnya, Khie Sin dengan lporan dengan nomor LP/B/0612/X/2022/SPKT/BARESKRIM POLRI tanggal 25 Oktober 2022, karena merasa dirugikan sampai miliaran Rupiah. Hal itu disampaikan Khie Sin, saat didampingi kuasa hukum, Matheus Ramses. Ia menjelaskan dugaan tindak pidana kejahatan perbankan itu terjadi berawal dari korban mengajukan kredit pada 2015 sebesar Rp15 miliar. Pinjaman itu terdiri dari Rp13 miliar pinjaman pokok dan Rp2 miliar cicilan yang akan jatuh tempo pada 2025 mendatang.
Selanjutnya pada 24 April 2017 pelapor kembali mengajukan kredit lagi sebesar Rp3,6 miliar dengan jaminan satu sertifikat tanah. Kejanggalan mulai terlihat di sini, karena setelah uang cair, tanpa sepengetahuan korban uang tersebut langsung dipotong untuk membayar cicilan pinjaman Rp2 miliar yang tersisa Rp1,7 miliar sebelumnya. “Pinjaman Rp3,6 miliar itu saya pakai modal kerja. Sedangkan utang Rp2 miliar itu saya lancar bayar cicilan. Kenapa dilunasi dengan cara seperti ini? Saya pinjam uang Rp3,6 miliar itu saya jaminkan dua sertifikat tanah,” ungkap Khie Sin di Denpasar, pada Sabtu (11/3/2023).
Kejanggalan berikutnya terjadi pada 9 Maret 2018. Korban diadendum tanpa sepengetahuan sebesar Rp1 miliar. Pada adendum itu tercantum untuk modal kerja. “Pada hari itu juga uang cair. Anehnya, uang langsung dipotong Bank BPR Lestari. Sisa di rekening saya sebesar Rp336.339,” bebernya. Tidak hanya dari dua kejanggalan tersebut, pada 29 Maret 2019 korban mengajukan pinjaman lagi sebesar Rp1,150 miliar dengan menjaminkan dua sertifikat tanah. Pinjaman ini untuk modal kerja. “Pada hari itu uang cair. Namun lagi-lagi dipotong oleh Bank Lestari tanpa alasan yang jelas. Uang miliaran rupiah itu hanya tersisa Rp13 juta. Saya pinjam untuk modal usaha kenapa uangnya dia yang pakai?,” bebernya.
Akibat dari ini semua, bunga pinjaman korban membengkak. Bahkan pembayaran tersendat-sendat dan berujung peringatan dari Bank BPR Lestari. Pada 28 Juni 2019 pelapor diundang ke bank dan diadendum lagi. Tanpa saya sadari diberi tambahan pinjaman Rp2,5 miliar. “Aneh, saya tidak mengajukan pinjaman. Dan lebih aneh lagi tambahan pinjaman sebesar itu tanpa ada jaminan. Tanpa saya sadari pinjaman pokok ditambah Rp2,5 miliar. Dan semua uang itu dipakai BPR Lestari. Bagaimana saya dikasih pinjaman lagi padahal utang sebelumnya saya bayar tersendat-sendat. Ini jebakan atau apa? Saya sudah berkali kali melakukan komplin langsung kepada direktur tapi tidak ada jawaban memuaskan,” lanjutnya.
Merasa dirugikan dengan kejadian ini akhirnya korban lapor ke Mabes Polri. Khie mengaku mengalami kerugian sekitar Rp32 miliar Kerugian sebesar itu dari sejumlah sertifikat tanah. Aset tanah itu sebagian sudah dilelang oleh BPR Lestari tanpa penetapan pengadilan. “Sudah ada empat aset yang dilelang. Uang lelang saya tidak dapat sepeserpun,” katanya. Dugaan kasus serupa juga dialami oleh I Made Sutrisna, Wahono Hisbuntoro, Kristy Dewi, dan puluhan lainnya yang semuanya sekitar 52 orang nasabah. Puluhan nasabah ini telah mengambil langkah hukum dengan melaporkan ke kepolisian. Mereka berharap agar aparat kepolisian segera mengambil langkah tegas.
Salah seorang korban lainnya bernama Kristy Dewi yang mengaku pada tahun 2019 mengajukan kredit di BPR Lestari sebesar Rp750 juta. Akibat Covid-19 pada 2020 pembayaran utang tersendat. Korban ke BPR untuk mengajukan relaksasi. Ternyata di sana tidak ada program itu, karena yang ada adalah top up. Tak ada pilihan korban mau top up. Uang top up itu masuk ke rekening, namun dananya tidak bisa diambil, tetapi digunakan untuk bayar bunga dan cicilan pinjaman yang tidak sanggup bayar tersebut.
Setelah dana top up itu habis maka harus top up lagi sampai ke empat dan dananya tidak bisa diambil. Top up pertama sebesar Rp80 juta, kedua Rp160 juta, ketiga Rp244 juta, dan keempat Rp330 juta. “Top up tetapi tidak terima uang. Dalam perjanjian kredit itu modal usaha. Artinya kita dikasi modal untuk berusaha. Bukannya kita dibantu malah dijebak. Bunga pinjaman saya terus membengkak. Uang top up masuk ke rekening tetapi tidak bisa diambil,” ungkap kata Ketut Suwirja kerabat Kristy Dewi.
Sementara Kuasa Hukum Khie Sin mengatakan, pihaknya sangat siap dengan laporan klien ke Mabes Polri. “Semua berkas dan dokumen sudah di Mabes Polri. Saat ini tinggal menunggu gelar perkara saja.Kami terus mendorong dan mempercayai polisi agar membuka tuntas kasus yang merugikan puluhan nasabah,” tegasnya. Apakah ada upaya damai? Pria asal Maluku Ambon ini mengatakan ruang damai dan negosiasi selalu ada. “Damai dan negosiasi bisa dilakukan dan terbuka. Dimana dan kapan silahkan saja. Sepanjang tidak merugikan klien kami,” kata Matheus.
Sayangnya ketika dikonfirmasi melalui pesan WhatsApp, Direktur Utama Bank BPR Lestari, Pribadi Budiono belum bisa memberikan tanggapan terkait laporan tersebut. Di sisi lain, Robert Khuana yang sebelumnya Kuasa Hukum BPR Lestari dikonfirmasi terkait laporan ini mengatakan dirinya belum mendengar adanya laporan itu. “Untuk hal itu saya belum diinformasikan dan membahas tentang kuasa karena kuasa yang lalu hanya terbatas beberapa nasabah dan sudah selesai melalui damai,” kata Robert Khuana dalam pesan singkatnya Sabtu (10/3/2023). tim/ong/ama/ksm
